Do I need a building licence to pave my driveway in Spain?
Usually you need some form of municipal paperwork, but it is not always a full licence. In Andalusia, Law 7/2021 (LISTA), article 138.1.a), places minor works of limited constructive scope that do not need a technical project under a responsible declaration rather than a licence. Its regulation is Decree 550/2022. Paving a private driveway or patio often falls into the minor works category, but the decision belongs to the town hall.
Each ayuntamiento's own ordinance sets out exactly which procedure applies to which type of job: responsible declaration, licence, or exemption. The same patio may be handled differently in neighbouring towns. For that reason we never tell owners that a job needs no paperwork without checking the local rules first.
We are a paving contractor: we execute the works. We do not draft technical projects, apply for licences on your behalf as a professional, or produce geotechnical studies. Where a project or technician is required, that is arranged by you, your architect or your gestor, and we work to their specification.
What is a declaración responsable?
A declaración responsable, or responsible declaration, is a formal statement submitted to the town hall in which the owner declares that the planned works comply with the applicable rules and that they hold any required documents. Once correctly submitted, works of that kind can generally begin, and the town hall checks compliance afterwards rather than granting permission in advance.
It is not a formality to ignore. The declaration describes the works, and if what is built differs from what was declared, or the works were not eligible for that route, the owner can face consequences. Which supporting documents must accompany it, for example a description of the works or a budget, is set by each town hall, so ask for the current form before you prepare anything.
- Licence (licencia): prior authorisation is granted before works start.
- Responsible declaration: you declare compliance, then the town hall checks.
- Exempt acts: certain works need neither, as set out in the local ordinance.
What applies in Málaga city and on the rest of the coast?
Málaga City Council's planning office reported in 2021 more than 40 types of works handled by responsible declaration and 22 types exempt from both licence and declaration, listed on its website under 'actos no sujetos a licencia'. Whether a specific paving job is on that list has to be checked case by case with the planning office.
For Marbella, Estepona, Fuengirola, Benalmádena, Torremolinos, Mijas and the other towns of the province, the procedure for a given outdoor paving job is set in the current municipal ordinance and should be confirmed with the town hall before starting. Ordinances are updated, so guidance that was true for a neighbour's driveway a few years ago may not apply today.
A practical route is to ask the town hall's urban planning department (urbanismo) directly, or to use a local gestor or administrator who handles these submissions routinely. When you have the answer, share it with us so the quote and the works match what is declared.
What if the work touches the pavement or kerb outside?
Anything on the public side of your boundary is different. If the job touches the public pavement, or involves lowering the kerb to create a vehicle crossing (vado), separate municipal authorisation is needed; the details are set by each town hall's ordinance.
We do not alter public kerbs or pavements without that authorisation in place. If your new driveway needs a dropped kerb, raise it early, because it can affect the layout and the level at the gate. Our sister site has more on villa and estate entrances, including how private paving meets the street.
When do I need the community of owners' approval?
If your property is part of a community of owners (comunidad de propietarios), the Horizontal Property Law, Ley 49/1960, applies. Work on common elements, such as shared driveways, communal paths, car parks or the areas around a pool, needs a resolution of the owners' meeting under the majority rules of article 17. The exact majority required for a particular job is something the community administrator confirms.
Even on a private garden or terrace that belongs to your unit, the community statutes may contain rules about appearance, materials or the use of shared access during works. Owners in urbanizaciones are often surprised by this. Ask the administrator (administrador de fincas) before you commit, and keep a copy of any resolution. For shared surfaces, the community is usually the client and a president or administrator is the point of contact. Our sister site covers car parks and communities in more detail.
What happens to the old paving and rubble?
Material lifted during paving work is construction and demolition waste. It is governed by Royal Decree 105/2008 and Law 7/2022 on waste and contaminated soils. Law 7/2022 treats rubble from minor domestic building and repair works as household waste under municipal responsibility Ask your town hall how it handles small quantities from a domestic job. On larger jobs, the waste is taken by an authorised manager and classified using the European List of Waste. Typical codes when lifting paving are:
- 17 01 01 – concrete.
- 17 01 07 – mixtures of concrete, bricks, tiles and ceramics without hazardous substances.
- 17 05 04 – soil and stones other than those in 17 05 03.
Removal of old material is part of our paving replacement service and is listed as its own item in the quote, so you can see how it is handled. Keep any waste documentation you receive with the rest of the job paperwork; it may be requested alongside your declaration or licence file.
What safety rules apply on a paving site?
Royal Decree 1627/1997 sets the minimum health and safety provisions for construction works, with or without a project. Even a domestic driveway is a construction site while machinery is running, so we keep the work area separated from family members, guests and pets, and plan deliveries and machine movements around access to the house.
If you will be living in the property or letting it during the works, tell us in advance. We can sequence the job so that one access stays usable, and agree when cutting and compacting, the noisiest stages, take place.
Owners abroad sometimes ask who is responsible for safety on a small job with no project. The contractor organises his own work safely; the owner's part is to give clear access, flag hidden hazards such as buried pipes, cables or an old septic tank, and keep the work area closed to others. Sharing any plans of buried services you have, even rough ones, helps avoid damage during excavation.
How do I prepare the paperwork before work starts?
- Describe the job clearly: area, current surface, new material, any changes of level or drainage.
- Ask the town hall urbanismo department, or a gestor, which procedure applies.
- If you are in a community, ask the administrator whether a meeting resolution is required.
- Check whether the work touches the public pavement or needs a vado authorisation.
- Obtain a written, itemised quote that matches the declared works.
- Keep copies of submissions, resolutions and the quote together.
We provide the itemised quote and a description of the works for your submission. For the paving itself, see our concrete block paving and concrete base for paving pages. Send us a photo and the approximate m² – free, no-obligation quote.
Frequently asked questions
Do I need planning permission for a block paved driveway?
In Andalusia, minor works with no technical project are generally handled by a responsible declaration under Law 7/2021 (LISTA), article 138.1.a), rather than a full licence. Each town hall's ordinance decides which procedure applies to your specific job, so check locally first.
What is the difference between a licence and a responsible declaration?
With a licence, the town hall authorises the works before they start. With a responsible declaration, you declare that the works comply with the rules, can generally proceed, and the town hall checks afterwards. The local ordinance determines which route applies.
Can you apply for the permit for me?
We execute paving works and do not act as a technical professional applying for licences or drafting projects. We supply an itemised quote and description of the works for your submission, which you, your gestor or your architect can file with the town hall.
Is paving work in Málaga city exempt from licence?
Málaga City Council's planning office reported in 2021 more than 40 types of works handled by responsible declaration and 22 exempt types, listed under 'actos no sujetos a licencia'. Whether your paving job is among them is checked case by case with the planning office.
Do I need permission to lower the kerb outside my gate?
Yes. Work on the public pavement or a kerb drop for a vehicle crossing, known as a vado, needs separate municipal authorisation. Details vary by town hall and are set out in each ordinance. We do not alter public kerbs without that authorisation.
When do I need my community of owners' approval?
Work on common elements, such as shared drives, paths or communal pool areas, needs a resolution of the owners' meeting under article 17 of the Horizontal Property Law, Ley 49/1960. The exact majority for each job should be confirmed with the community administrator.
Does my community have a say over my private terrace?
Possibly. Even where a terrace or garden belongs to your unit, community statutes may set rules on appearance, materials or use of shared access during works. Ask the administrator before committing, and keep a copy of any written answer or resolution.
What happens to the rubble from my old driveway?
Lifted paving is construction and demolition waste, governed by Royal Decree 105/2008 and Law 7/2022. It is removed and taken to an authorised destination. Typical waste codes include 17 01 01 for concrete and 17 01 07 for mixed concrete and ceramics.
Which safety rules apply to a small domestic paving job?
Royal Decree 1627/1997 sets the minimum health and safety provisions for construction works, with or without a project. In practice that means separating the work area, planning machine movements and deliveries, and keeping residents and guests away from cutting and compaction.
Can I start work while waiting for the town hall?
It depends on the procedure. With a responsible declaration, eligible works can generally start once it is correctly submitted. With a licence, you must wait for the authorisation. Confirm which applies with the town hall before setting a start date.
